    Notes:

Joseph apparently died between 1880 and 1889. Joseph appears in the 1880 census. In the 1889 Bay City Directory, Sarah is listed 'widow of Joseph'.

Unable to find death record in tuscola, bay or saginaw.

No record of Joseph Schultz in the Tuscola County Probate Index.

Tuscola County Deed Record. 28 May 1884 Sarah R, Shultz Purchased 40 acres from Joseph R. Shultz for $700 (NW 1/4 of the NW 1/4 of section 14 of Town 13 of Range 8E). The sale of his share of the real estate to the wife is suggestive of a divorce settlement. Although later she is listed as a widow.

Joseph married Sarah Rebecca Phelps on 15 Dec 1861 in Fairgrove, Tuscola, Michigan, USA. Sarah (daughter of Norman Phelps, Jr and Minerva Burdick) was born in Apr 1845 in New York, USA; died on 5 Apr 1932 in Bay City, Bay, Michigan, USA; was buried on 8 Apr 1932 in Fairgrove, Tuscola, Michigan, USA. Notes:

Sarah Rebecca Phelps was born 1845 in Fort Ann, New York to Norman Phelps and Minerva Plum Burdick . She married Joseph Oscar Shultz (b 1837 in Pennsylvania) in Fairgrove, Tuscola, Michigan on 15 Dec 1861 in a ceremony performed at the home of William Irish (who is married to her niece, Henrietta Phelps), per the Tuscola County Marriage Ledger. She died 05 Apr 1932 in Bay City, Bay, Michigan.

Sarah Phelps appears on the 1850 census in Fort Ann, New York with her parents, Norman and Minerva.

Sarah R Phelps appears on the 1855 New York State Census for Fort Ann living with her parents, Norman and Minerva.

We have been unable to locate Sarah Phelps on the 1860 census.

Our next record of her is her marriage 15 Dec 1861 in Fairgrove, Tuscola, Michigan.

The census records for 1870 and 1880 show her living in Fairgrove.

She lived in Fairgrove near William and Henrietta Irish and apparently had a close relationship with them. We find Sarah's name on the wedding records of two of Williams daughters, Mary as a witness and Sophronia as a mother! (This was after Sophronia’s mother, Henrietta had died, either an error or an honorary title???)

Sometime between 1884 and 1889 her Husband Joseph had died. She moved to Bay City, Bay, Michigan and is listed in the 1889 City directory as ‘widow of Joseph’. Also on the 4 census records from 1900 to 1930 she is listed as a widow.

On the 1894 Michigan Census and the 1900, 1910, 1920 and 1930 Federal census she is living in Bay City at 515 Polk. The Bay City city directory lists her address as a dairy. Her occupation selling milk.

She died in Bay City on 8 Apr 1932. She is buried in Fairgrove (AKA Brookside) Cemetery. Her stone reads Sarah R Schultz 1846-1932. (most documentary information has her born in 1845 including census records for 1850, 1855, 1920, 1930, her marriage certificate and her newspaper obit)

She is mentioned as a surviving sister in the 1923 obituary of her brother Andrew J Phelps of Fort Edward, NY.
On 14 Mar 1878 Sarah R. Shultz of Tuscola County, Michigan received consideration of $5 to sign off her interest as an heir of Norman Phelps Jr in the real estate of which was transferred by Norman Phelps Sr (to his children in 1839), lot 53, Lake George Tract in Fort Ann, NY. (on file with the Washington County, New York, Clerk) -see Norman Phelps, Jr property notes.
listed in 1889 Bay City directory Schultz Sarah, widow joseph, res 515 Polk

4/16/08 Terry had conversation with Dorothy Seeley (daughter of Harry Seeley). Dorothy remembers her Gramma (Sarah Phelps) Schultz. This gramma used to go for walks by Dorothy's house and then stop in to say hi. Then she would go home. Dorothy just a little girl then, remembers Gramma Schultz (our Sarah) as a tiny short little lady. Uncle Reube used to live with her she told me.

8/16/18- notes from terry on cemetery.:
Lot numbers online for Brookside are not right. In Lot #449 are per Brookside records (which began after 1921 Sexton house fire):
Grave 1 west side, no stone is Eunice (Bills) Schultz
Grave 2 West side is Sarah R. Schultz
Grave 4 East half is Wm. Schultz
Grave 4 West is H. Schultz

No other burials are listed in the Sexton records as being in lot 449. The lots are all 8 people lots with 4 buried on East and 4 buried on West. The Sexton said the grave #s meaning grave 1,2 etc and the east & west info could be mixed up. He has the longitudinal and latitude directions for them also.

The Sexton told me an interesting story. As we know Brookside began around 1898 when the owner of the property where Hinson cemetery was wanted all graves removed from his land. So graves and markers were removed. The Sexton Doug Foster remembers his brother’s telling him how they would go look for Indian arrowheads on the Land where the Hinson cemetery was 50 years ago when they were kids. They seen grave stones when looking for the arrowheads. So obviously not all were removed. Now there are wind turbines going up in that area so digging is going on.

    DEATH:
21 Aug 1853 in Tuscola County, Michigan. Date from gravestone inscription.

    BURIAL:
Juniata Township Cemetery AKA Watrousville Cemetery Juniata Township, Tuscola, Michigan. Gravestone reads J K Shultz, died 21 Aug 1853, aged 41 years 11 months, 21 days.

    NOTES ON GRAVESITE:
Basically Watrousville is a few buildings on the corner of M-81 and Ringle Rd in Tuscola County. Just west of the corner on the north side of the road is the Juniata Township Cemetery. The cemetery is also referred to as the Watrousville Cemetery. The cemetery is small, just a few hundred graves. I found it to be quite clean and well maintained.

The first group of stones I came to look for consists of 3 graves, but 2 stones. The taller stone, about a 3 1/2 foot tall spire, is engraved on the left side J.K. Shultz DIED Aug. 21, 1853 Aged 41 yrs 11 mos 21 days. The opposite side is engraved Hannah Shultz DIED Dec 10, 1865 Aged 50 yrs 1 mo 5 days. Right next to this taller stone is a stone engraved C.A. Schultz Co F 2 Mich Inf. Next to the stone is an American flag. Right behind the stone is a metal plaque which reads Albert C Schultz Corp Co F 2 Mich Inf Civil War. (Note how it went from C. A. to Albert C.)

The next group of stones I wanted to look at consists of 3 stones in a row with a fourth stone in the middle represented only by a base in the ground. The first stone is engraved Lucia E wife of Andrew Shultz died Mar 13, 1867 Aged 27 yrs 1 mo 27 dys. The 2nd stone is engraved Lucia (hard to read-but here goes) 22 Aug 1877 10 yrs m 20dys daughter of A & L Shults. The third stone is the one which is missing. (According to Gloria Hall in 1939 the stone was read as Andrew Shults died 18 Jan 1873 age 63 yrs 3 mo 14 dys. With a note in the 1990’s that the stone is now missing.) The fourth stone reads Samuel infant son of A & L Shults Died Mar 9, 1866.

The final group of stones which I wanted to see consists of 3 stones. The first reads Emiley Smith(Emily Shultz) Died Jan 1 A.D. 1865 Aged 17 yrs 7 m’s 8 d’s. The next stone reads George Spickerman Died Sept 5, 1883. Aged 10 yrs 5 mos 21 dys. The final stone reads Harriet C Spickerman Mother of George Spickerman Apr 21, 1851 Apr 13, 1929

    NOTES ON PROBATE RECORDS:
File #1-89, Tuscola County, Michigan Probate Records, Estate of Jesse K Shultz:
We show Jesse Shultz dying in 1853, but the probate file was opened in 1866. Hannah, Jesse's wife died in Dec 1865 which is what triggered the probate, because now the real estate and other assets had to be disbursed to the heirs. I think that the prevailing law is that the real estate belongs to the husband, but the wife can stay there until she dies, then it goes into probate. Many of the papers mention the estate of both Jesse K Shultz and C Albert Shultz, deceased. (he is also referred to as Albert Shultz or Charles Albert Shultz on one paper). C Albert is one of Jesse's sons on the census, so apparently he died between 1860 and 1866. There is also a reference to the estate of Hannah Shultz. So all 3 people are included in this one file.
Jesse Fox (the spouse of Lucinda Shultz) was appointed guardian of the minors; Thomas Shultz, Harriet Shultz and Jesse Zephaniah Shultz (also referred to as Zephaniah Shultz or Jesse Z).
The date of death is almost never mentioned, it is always the previously deceased, so I would guess that the date is not important to the probate court. Fortunately one of the receipts for services rendered listed an approximate date for Jesse's death. William Johnson, apparently a Doctor billed the estate for services performed: "surgical services provided to Mr. Shultz in 1852 (“or at the date of his death”) and on Mrs. Shultz at her death in December 1865; (only one paper had an actual death date for Jesse K, but it was not entirely legible, I could read Aug 1853), (from cemetery transcriptions we know Jesse K died 21 Aug 1853 and Hannah died 10 Dec 1865).
    So, who are the heirs?
Lucinda Fox (who also purchased the rights of Joseph Shultz in the estate of C.A. Shultz), Mary E Russell of Juniata (Mary’s husband, Henry E Russell is the administrator of the estate) Thomas Shultz of Fairgrove, Harriet Shultz, Zephaniah Shultz and Albert A Smith (this would be the child of Emily who died 1 Jan 1865, leaving 2 month old Albert without a mother). (Emily was married to Alanson Smith, I do not know what happened to him). Also David Altingburg (Altingberry?) purchaser of the rights of Joseph Shultz, I believe in regards to Jesse K estate. Apparently my ancestor was in need of quick cash at the time.
There is a receipt where Joseph Shultz signed for his share of the estate of C Albert Shultz. He received $48.84. It is signed Joseph O. Shultz.
58 papers in the file, some of them written on both sides, so a lot to look up. Other items of interest.
Gearhart Kile filed an objection to the sale of the estate in that it was not handled fairly. He stated that he was prepared to offer $2000 for the real estate, as were other people and that it was sold for too little. Gearhart apparently wanted to purchase the estate using credit terms for part of the payment, which is why his bid was not allowed.
The auctioneer filed a statement that the sale held at the hotel of G.W. Buddington of Watrousville was conducted fairly. He obtained a bid of $1662. He announced to everyone in the room, that if he did not receive a higher bid he would close the sale. He then closed the sale. The judge ruled that the sale was conducted fairly.
There was also a petition filed by Jesse Fox that Henry E Russell had concealed and disposed of certain assets. I cannot tell what that was about.
There is also a note that papers are missing from the file.

  2. 9.  Hannah GibbonsHannah Gibbons was born on 5 Nov 1815 in Pennsylvania, USA (daughter of Charles Gibbons and Sarah Davis); died on 10 Dec 1865 in Tuscola, Michigan, USA; was buried in Juniata, Tuscola, Michigan, USA.

    Other Events:

    • Name: Hannah Mayberry
    • Reference Number: 6089
    • Residence: 1850, Hayfield, Crawford, Pennsylvania, USA
    • Residence: 1860, Juniata, Tuscola, Michigan, USA

    Notes:

NOTE: It is our belief that Hannah Gibbons is the daughter of Charles Gibbons of Sugarloaf, Columbia, Pennsylvania. However, we only have circumstantial evidence. It is as follows:
    a) After Hannah and Jesse had both died by 1865, the remaining family scattered. Her son Jesse Z ended up in the household of Samuel GIbbons in Benton Township, Pennsylvania by 1870 (when he would have been 17). Samuel Gibbons is a son of Charles Gibbons and he has the same surname as Jesse's mother. This indicates family relation.
    b) When Hannah GIbbons married Jesse K in 1835 the Charles Gibbons family lived only a few households away from Jesse per Sugarloaf census records. Charles Gibbons along with his sons Reuben, Samuel, Thomas, Charles and Isaac are also the only known GIbbons families in the county.
    c) We have nine autosomal DNA matches to descendants of Charles Gibbons. Two through his son Thomas, five through his daughter Sarah, One through son Charles and 1 through daughter Mary, which all match our line through his daughter Hannah.
This adds up to strong circumstantial evidence that Hannah is the daughter of Charles Gibbons.

NAME: The only records we have of her maiden name is the death certificate of her child Jesse Z. Schultz listing Hannah Mayberry as his mother and her daughter Harriet on her 3rd marriage listing Jesse Schultz and Hannah Gibbons as parents. This creates considerable doubt on her maiden name. Perhaps a previous marriage? Charles Gibbons b. 1781 d 1857 lived in Sugarloaf. No record of a will in the probate index. No deed records in Columbia County. As the marriage record maiden name was reported by Hannah's daughter and the death record maiden name was reported by an unknown relative? of Jesse Z, I would have to give more weight to the Gibbons name. Also the fact that in 1870, Jesse Z was apparently listed in the household of Samuel Gibbons on the census gives more weight to the Gibbons name. Also the fact that there was a Gibbons family living nearby at the time of the marriage and that there were no known Mayberry families in the county gives more weight to the Gibbons name.

BIRTH: 5 Nov 1815 in Pennsylvania. Date from gravestone inscription. Place from Census.

    PARENTS:
We have no documentary information on her parents. In 1840 the household was living in Sugarloaf, Columbia County, Pennsylvania with Jesse’s father Samuel as the next entry on the census record. There were no Mayberry’s listed in Columbia County in 1840, although there was the Charles Gibbons family living in SugarLoaf.

    MARRIAGE:
6 Mar 1835 to Jesse K Shultz b. 30 Sep 1811 in Pennsylvania. (per a 2/17/1982 family tree chart on file with the Columbia County Historical and Genealogical Society in Bloomsburg, PA-unable to find confirming document)

    Notes:

    NORMAN PHELPS JR

Norman Phelps Jr was born in the vicinity of Bradford, Vermont on 9 Nov 1787. We arrived at this conclusion after analyzing much confusing and conflicting information. The phelpsinc.com website shows Fort Ann, New York in Nov 1788. Norman Phelps himself had listed 4 different States of birth on 4 different census records; New York (1850), Massachusetts (1855), Vermont (1860) and Connecticut (1870)!! This confusion is apparently from his father Norman Phelps, Sr having moved around considerably during the few years before and after Norman's birth. This movement is logged in Norman Sr's military pension file. Approximate dates are given for each move in terms of number of years after the war. It is very approximate. Apparently Norman was aware of the movement, but was himself confused as to which State his father was actually living when Norman Jr was born. The only documentation we have is a log entry by Mrs. Lydia Phelps Baldwin of Bradford, Vermont who logged every birth she attended over a 52 year span, over 500 names (New England Historical & Genealogical Register 1950 Vol 104 P263). She recorded the birth of a son to Norman Phelps on 9 Nov 1787. Unfortunately she did not record the spouses name or the sons name, so we can not be certain that this is the same person. However Norman Sr did not have any sons other than Norman in this time period. Mrs Baldwin was a first cousin to Norman Sr and a review of her log entries shows that she also assisted in delivery of Dewey and Horsford children who were related to Norman Sr's mother, Desire Dewey. Norman Jr's grave stone shows died 19 May 1871 age 83 & 6 mos, which is Nov 1787. Considering that his father's pension record shows that he was in Vermont in that approximate time period and that the midwife keeping the log was his fathers close relative, then this birth date and place becomes quite plausible.

According to the 1790 Federal Census Norman was living in Kingsbury. According to his fathers pension file, they lived in Kingsbury for a total of 3 years then moved to Fort Ann where Norman Jr lived until sometime prior to 1870 when he moved to Queensbury, New York.

The records for the War of 1812 show Norman Phelps Jr as a private in the 23rd Regiment (Cook's) of the New York Militia.

He died 19 May 1871 in (Queensbury) Warren County, New York. He is buried in Seelye Cemetery in Warren County, New York.

    Notes:

    BIRTH:
Abt 1803 in Warren County, New York. We have birth years running from 1801 to 1811 from various census records. We are using 1803 as that is what is on her gravestone in Seelye Cemetery.(Other than the 1811 dates, all other entries are 1801-1805) Three New York State census records (1855, 1865 , 1875) show her birthplace as Warren County. We have no record of her parentage. They were several Burdick families in Warren County at the approximate time of her birth. We believe her parents were Daniel Burdick and Annie Shaw of Caldwell (now called Lake George). The 1810 census shows two female children under the age of 10. One of which could be Minerva. We also show a DNA match with Daniel's brother Ephraim. We also show a DNA match with Annie's brother Ephraim, Annie's brother David and 3 matches with Annie's sister Mary.

    MARRIAGE:
1st marriage to Fredrick Plumb by 1824. Based on Frederic Plumbe and his wife Minerva Plumbe being named on a court summons dated 24 Apr 1824. The birth of their only known child, Martha Minerva Plumb 30 Oct 1838 was in Bolton, Warren, New York. This birth is based on the Death Certificate of Martha Minerva, where birth date and parents’ names are given.
2nd marriage abt 1842 to Norman Phelps Jr. Marriage date based on wording in 1855 New York State Census for Fort Ann, Washington County. Minerva listed living in Washington County for 13 years, while her husband listed living in Washington County for life. This could imply that Minerva moved to Washington County upon her marriage to Norman Phelps. First child (Andrew James Phelps) has birth date listed of 30 Dec 1842 (12 1/2 years earlier) on his death certificate. (Although only Norman's name is listed on certificate as parent). 1865 NY census states married 2 times and 10 children. We believe that this means 10 children total for her and Norman. We only know of 9. Possibly her and Frederic had an earlier child that we do not know about.

1824 Court Case: 1824 court case. She testified against Isaac Simpson, as he was charge with raping her. Documents in the Warren County Archives show some details in the case, but do not show if Simpson was convicted or not.
