I, Phillip Shults of the Township of Greenwood in the county of Northumberland in the State of Pennsylvania being sick and weak of body but of sound mine and memory and calling to mind the certainty of death and uncertainty of life do make and ordain this my last will and testament in manner and form following that is to say firstly and principally I commit my soul into the hand of almighty god who gave it and my body to be buried in a decent and becoming manner at the discretion of my Executors hereafter named and secondly I order all my just debts for funeral expenses to be paid and discharged by my Executors as soon as may be out of my Estate items. I give and bequeath to my beloved wife Barbary my Plantation whereon I now dwell farming fifty one acres with the appurtenances hereunto belonging to her use and benefit together with all household & kitchen furniture with two cows & seven sheep and give all the residue of moneys that may be left after my debts are paid aforesaid. All of which I give and bequeath to her for her use and benefit to have & to hold during her natural life and no longer. From and after which time & as soon as is convenient my will further is that my plantation be sold either at public or private sale for the best price that can be conveniently had for it. I hereby impower my executors hereafter named to make as good a title or titles to the purchaser or purchasers as I myself might or could have done were I personally present. And I further order that all of my personal property that my wife may be possessed of at the time of her decease by sold at either public or private sale and the money arising therefrom together with the money arising on the sail of my plantation, I give and devise to my twelve children namely, Daniel, Elisabeth, Katterean, Ann, Sarah, Mary, Samuel, John, Peter, Margret, Nancy & Joseph to be equally divided amongst them share and share alike and to be paid to them as soon as the money can be collected by my executors and lastly, I constitute and appoint my son Daniel Shults and my trusty friend William Mather to be my whole and sole Executor to this my list will and testament disannulling and making void all other wills or testaments by me heretofor made declaring this and no other to be my last will and testament in testimony whereof I have hereunto set my hand and seal the eleventh day of March in the year of our lord one thousand eight hundred and thirteen. JUNIATA

This town is bounded on the north by Fair Grove, having Denmark on the west, Vassar to the south and Indian Fields east. Cass River flows through the southeast corner of the town, about three sections lying to the south and east of the river. The most of the town is rolling; about one-third perhaps, in the southeast corner, along the river, being level and having a more sandy soil than the other two-thirds, which is generally a clay loam.
This was among the earliest settled towns in the county. The first settlers in the town were Levi Rogers and family, who came in early in 1850. The first blow struck for improvement was by Andrew Jackson Rogers on land which his father had purchased of Townsend North. From Levi Rogers the town took the name of Rogers under which it was organized.
Shortly after came two German families, and about the same time William Jameson, Jonas Belknap, Ezra A. Belknap, John Freeman, S. H. Moore, Daniel Gorton Truman, and within the next two years Patrick McGlone, Ephraim Smith, Frank Fairhan, Daniel Kinyon, King Allen, Hiram Gibbs, Lucius Marvin, James Wing, Henry S. Russell, William Law, Andrew Schultz, Nelson Vickery, William Fenner, Daniel T. Tonkrey, E. Miller, R. G. Black.
Until 1852 the only roads were the lumberman’s supply and logging roads, very serviceable in winter but almost impassable in spring and summer. In 1852 a road was laid out from the present site of Watrousville which was cut through in 1853, the people generally turning out and helping to open the road. The commissioners to lay out this road were Jackson Rogers and William Jameson. Martin Miller, of Tuscola, was surveryor.

I Andrew Shults of Juniata in the County of Tuscola in the State of Michigan being of sound mind and memory do make and declare this my last will and testament in manner following: That is to say I give and devise unto my daughter Hannah Lucia Shults of my farm the following described plat of land: namely the north half and the south east 1/4 of the north east quarter of section 10 in township 12 north of range 8 east in the county of Tuscola and State of Michigan to have and to hold this said lands ( ) and ( )with ( ) appurtenance to her said Hannah Lucia Shults her heirs and assigns forever. Juniata Township Cemetery AKA Watrousville Cemetery Juniata Township, Tuscola, Michigan. Gravestone reads J K Shultz, died 21 Aug 1853, aged 41 years 11 months, 21 days.

NOTES ON GRAVESITE:
Basically Watrousville is a few buildings on the corner of M-81 and Ringle Rd in Tuscola County. Just west of the corner on the north side of the road is the Juniata Township Cemetery. The cemetery is also referred to as the Watrousville Cemetery. The cemetery is small, just a few hundred graves. I found it to be quite clean and well maintained.

The first group of stones I came to look for consists of 3 graves, but 2 stones. The taller stone, about a 3 1/2 foot tall spire, is engraved on the left side J.K. Shultz DIED Aug. 21, 1853 Aged 41 yrs 11 mos 21 days. The opposite side is engraved Hannah Shultz DIED Dec 10, 1865 Aged 50 yrs 1 mo 5 days. Right next to this taller stone is a stone engraved C.A. Schultz Co F 2 Mich Inf. Next to the stone is an American flag. Right behind the stone is a metal plaque which reads Albert C Schultz Corp Co F 2 Mich Inf Civil War. (Note how it went from C. A. to Albert C.)

The next group of stones I wanted to look at consists of 3 stones in a row with a fourth stone in the middle represented only by a base in the ground. The first stone is engraved Lucia E wife of Andrew Shultz died Mar 13, 1867 Aged 27 yrs 1 mo 27 dys. The 2nd stone is engraved Lucia (hard to read-but here goes) 22 Aug 1877 10 yrs m 20dys daughter of A & L Shults. The third stone is the one which is missing. (According to Gloria Hall in 1939 the stone was read as Andrew Shults died 18 Jan 1873 age 63 yrs 3 mo 14 dys. With a note in the 1990’s that the stone is now missing.) The fourth stone reads Samuel infant son of A & L Shults Died Mar 9, 1866.

The final group of stones which I wanted to see consists of 3 stones. The first reads Emiley Smith(Emily Shultz) Died Jan 1 A.D. 1865 Aged 17 yrs 7 m’s 8 d’s. The next stone reads George Spickerman Died Sept 5, 1883. Aged 10 yrs 5 mos 21 dys. The final stone reads Harriet C Spickerman Mother of George Spickerman Apr 21, 1851 Apr 13, 1929

NOTES ON PROBATE RECORDS:
File #1-89, Tuscola County, Michigan Probate Records, Estate of Jesse K Shultz:
We show Jesse Shultz dying in 1853, but the probate file was opened in 1866. Hannah, Jesse's wife died in Dec 1865 which is what triggered the probate, because now the real estate and other assets had to be disbursed to the heirs. I think that the prevailing law is that the real estate belongs to the husband, but the wife can stay there until she dies, then it goes into probate. Many of the papers mention the estate of both Jesse K Shultz and C Albert Shultz, deceased. (he is also referred to as Albert Shultz or Charles Albert Shultz on one paper). C Albert is one of Jesse's sons on the census, so apparently he died between 1860 and 1866. There is also a reference to the estate of Hannah Shultz. So all 3 people are included in this one file.
Jesse Fox (the spouse of Lucinda Shultz) was appointed guardian of the minors; Thomas Shultz, Harriet Shultz and Jesse Zephaniah Shultz (also referred to as Zephaniah Shultz or Jesse Z).
The date of death is almost never mentioned, it is always the previously deceased, so I would guess that the date is not important to the probate court. Fortunately one of the receipts for services rendered listed an approximate date for Jesse's death. William Johnson, apparently a Doctor billed the estate for services performed: "surgical services provided to Mr. Shultz in 1852 (“or at the date of his death”) and on Mrs. Shultz at her death in December 1865; (only one paper had an actual death date for Jesse K, but it was not entirely legible, I could read Aug 1853), (from cemetery transcriptions we know Jesse K died 21 Aug 1853 and Hannah died 10 Dec 1865).
So, who are the heirs?
Lucinda Fox (who also purchased the rights of Joseph Shultz in the estate of C.A. Shultz), Mary E Russell of Juniata (Mary’s husband, Henry E Russell is the administrator of the estate) Thomas Shultz of Fairgrove, Harriet Shultz, Zephaniah Shultz and Albert A Smith (this would be the child of Emily who died 1 Jan 1865, leaving 2 month old Albert without a mother). (Emily was married to Alanson Smith, I do not know what happened to him). Also David Altingburg (Altingberry?) purchaser of the rights of Joseph Shultz, I believe in regards to Jesse K estate. Apparently my ancestor was in need of quick cash at the time.
There is a receipt where Joseph Shultz signed for his share of the estate of C Albert Shultz. He received $48.84. It is signed Joseph O. Shultz.
58 papers in the file, some of them written on both sides, so a lot to look up. Other items of interest.
Gearhart Kile filed an objection to the sale of the estate in that it was not handled fairly. He stated that he was prepared to offer $2000 for the real estate, as were other people and that it was sold for too little. Gearhart apparently wanted to purchase the estate using credit terms for part of the payment, which is why his bid was not allowed.
The auctioneer filed a statement that the sale held at the hotel of G.W. Buddington of Watrousville was conducted fairly. He obtained a bid of $1662. He announced to everyone in the room, that if he did not receive a higher bid he would close the sale. He then closed the sale. The judge ruled that the sale was conducted fairly.
There was also a petition filed by Jesse Fox that Henry E Russell had concealed and disposed of certain assets. I cannot tell what that was about.
There is also a note that papers are missing from the file.

G. KILE was born in Pennsylvania in 1852, and came to Tuscola County with his parents in 1856, and settled upon the farm now owned and occupied by the subject of this sketch. His father, N. Kile, died in July 1858. Mr. Kile was married in October, 1880, to Miss Tilley Fritz, of Pennsylvania, and has one son. His farm contains 160 acre of land on sections 12 and 13.

G. KILE, SR., was born in Columbus County, Pa., in 1818, remaining there until he became of age. In 1838 he was married to Miss Nancy Schultz, of that county, and soon thereafter bought a piece of land in the locality and commenced farming for himself, which he continued until 1852 when he sold out and came to Michigan. He at first rented a farm near Ann Arbor, upon which he resided two years, when he came to the township of Juniata and, after traveling a long distance through the unbroken wilderness, took up the farm upon which he now resides, and subsequently added eighty acres, making him a farm of 160 acres.

V. R. SHULTZ, farmer, P. O. Danville, was born January 13, 1820, in this
township, fourth son of Peter SHULTZ. Jacob SHULTZ, grandfather of our subject,
was a very early settler in this county, and was driven away from his home
several times by the Indians, and forced to take refuge in the fort. To Jacob
and his wife were born the following children: Peggy, Polly, Betsey, Peter,
Jacob, Philip and John, all of whom reared families. Peter, the father of our
subject, and a farmer by occupation, was born in 1789, and came to this county
when a small boy. He married Sarah, daughter of Vincent ROBBINS, and by her had
eight sons and one daughter: William, Jonathan, Jacob, V. R., James B., John K.,
B. F., Peter R. and Mary. Vincent R. SHULTZ was born in what is now West
Hemlock, Montour County, and was reared on the farm until he attained his
majority, when he was married to Elizabeth, daughter of John and Mary (LONG)
COX. After his marriage he located on the farm he now owns, which was covered
with timber and which he has since cleared. Mr. and Mrs. SHULTZ have four
children: Melinda M., wife of henry COOPER, of Derry Township; Sarah C., wife
of Hiram TURNER in Madison Township; Jane, wife of John JOHNSON, of Jerseytown,
and Lloyd C., of this county. Mr. SHULTZ has been a member of the Methodist
Episcopal Church for forty-five years; his wife since she was fourteen years of
age; he has served as class leader. Politically Mr. SHULTZ is a Democrat. Has
been justice of the peace for twenty-five consecutive years; and school

There is also an abbreviation DisFD which has to do with a disability discharge.

From the probate files we know that the child known as Albert Shultz (also known as C. Albert Shultz or Charles Albert Shultz) died before 1866. As he was alive in the 1860 census, that gives us a 6 year window for his date of death.
His enlistment records shows that in Dec 1863 he was 20 years 10 months old, (although census records showed him to be 4-5 years older) a resident of Watrousville and born in Columbia County, Pennsylvania. He signed his name Albert Shults.

An online listing of Michigan Civil War Rosters (<http://www.michiganinthewar.org/infantry/2compf.htm>) lists Albert Shultz age 21 of Genesee County, Michigan in Company F, 2nd Michigan Infantry.

The ancestry.com civil war database lists Albert Shultz of Genesee County enlisted in Company F, 2nd Michigan Infantry on 24 May 1861 at Fort Wayne, Michigan. He was 21. He received a disability discharge on 28 Jul 1865.

His war Department record reads:

“Captured at Petersburg, Va July 30, 1864, paroled at James River, Va Feb 22, 1865, reported at Camp Parole, Md., date not given, sent to Camp Chase, Ohio, Feb 26, 1865, reported there March 4, 1865 and sent to Columbus, Ohio, April 25, 1865. He rejoined Co. May 25, 1865. Was admitted to Carver General Hospital Washington D.C. June 22, 1865, from regimental hospital with Chronic Pneumonia and was transferred July 11, 1865. Entered Stanton General Hospital Washington D.C. July 17, 1865 with congestion of the lungs, was discharged from service at this hospital July 28, 1865, on Surgeons Certificate of disability.”

Army of the United States Certificate of Disability for Discharge states that Albert Shultz was incapable of performing the duties of a soldier because of: “Phthisis Pulmonalis acquired since enlistment by exposure while a prisoner at Danville, Virginia from July 1864 to February 1865-Disability total. Signed July 28, 1865 at Stanton General Hospital Washington, D.C.

On 28 May 1866 his name is mentioned in the “estate of C.A. Shultz” in Tuscola County Probate records, so he died sometime before that.

This brings up some questions. Did he stay hospitalized after discharge or was he simply sent home? Did he die at home? I would think that likely he died of Chronic Pneumonia brought on by the conditions at the POW camp. So although he did not die as a prisoner of war, he most likely died as a result of being a prisoner of war.

When Albert reached adulthood he legally changed his name to Albert Kile. It is our belief that Nancy Kile, whose maiden name is Nancy Shultz (the daughter of Samuel Shultz and Mary Norberry of Columbia County, Pennsylvania) was an Aunt to Albert.

Jesse Zephaniah Shultz was born in Michigan on 20 Sep 1853 (date per the inscription on his gravestone) to Jesse K Shultz and Hannah Mayberry.

In the 1860 census (indexed under Sultz) we find him living in Juniata, Tuscola, Michigan with his mother and other siblings.

In 1866 Jesse's sister, Lucinda and her husband Jesse Fox were named guardians of Jesse Z along with his siblings, Thomas and Harriet.(Tuscola County probate packet 1-89)

In 1870 we have a possible census entry in Luzerne County, Pa where a J Z Shultz (indexed as J G Shultz on ancestry.com), age 17, born in Michigan is living in the household of Samuel Gibbons (this may be his mother's brother) as a laborer. Everyone else in the household was born in Pennsylvania. It may be reasonable to assume that after the mother died in 1865 (the father having died in 1853), the family dispersed.

On 31 March 1875 Jesse Z married Mary Francis Dawson in Botetourt, Virginia per Virginia Marriage records.

In 1880 we find Zeph Schultz (age27,born Mich) and Francis Schultz (age26, born VA) living in Sherman, Grayson, Texas with their two children Jesse (age 4, born VA) and Freddie (age 2, Born W VA).
